Important: do not use this video consultation service in case of a medical emergency. If you are in a medical emergency, please call your GP, visit the nearest Emergency Department or just call an ambulance immediately. Drjonasmed does not take responsibility for any damage, loss or deterioration of any emergency situation.

Terms of Use

DrJonasMed is an application and website that enables telemedicine consultations between doctors, healthcare professionals and patients via video conferencing. We provide a platform that allows patients to request and participate in consultations with doctors and healthcare professionals through DrJonasMed service.

Using the platform, you agree to be bound by the terms of this agreement and all other terms and policies that appear on the platforms (including any terms set out in our privacy policy at DrJonasMed.com).

Your account

 You will need to have an account in order to access the services via the website. You may sign up for an account on the website. The registration process requires you to provide your personal information, including your name, ID/passport number, policy number, date of birth, address, telephone number, email address and/or such other information as may be required by us.

You shall comply with all the security procedures applicable to the website which we may introduce from time to time.

You shall, in your sole responsibility, maintain the confidentiality of your account information for the website (including any user IDs and passwords) and you will be responsible for any disclosure or unauthorised use thereof. You shall not at any time disclose such account information to any other party.

 If you believe that the security of your account information has been compromised, you shall notify us immediately.

By signing up for an account via the Platforms, you represent and warrant that:

  • you are at least 18 years of age;
  • you have the full right, power, and legal authority to enter into this Agreement;
  • all information, data and particulars that you provide is complete, accurate, true and correct; and
  • you will use the Platforms for your personal use only and you will not authorise other persons to use your account nor transfer or assign it to any other person.

We shall be entitled, in the exercise of our sole discretion, to  refuse your registration if you fail to fulfil any one of the eligibility criteria above;  suspend/terminate your account and/or  change the above eligibility criteria at any time.

Use of the Platform

Subject always to your continuing compliance with the terms of this Agreement, we agree to grant you a non-transferable, non-sublicensable and non-exclusive licence to use the Website  on your device for the purpose of obtaining the services.

If you are using the video consultation functionality, you acknowledge and agree that:

 

  • you are responsible for the correctness and accuracy of the information, particulars, statements, photographs, laboratory test results or diagnostic images uploaded by you to DrJonasMed.com
  • you shall be personally liable to and pay any fees or charges in accordance with our terms and conditions coming into effect at the time they are incurred;
  • you shall ensure that the internet connection to which your Device is connected is of sufficient quality and strength to host a video consultation, otherwise the quality of our video and/or audio consultantion may be suboptimal and less than expected. We shall not be responsible for any such suboptimal experience you may have as a result these technical errors. We are doing everything we can to make your experience with us as good as possible.

Suitable use

You should use the immediate consultation service:

- For your intended use only and

- Respectful of other users and health care professionals.

You must not use the Service for anything else including but are not limited to:

- any illegal or unlawful purpose;

- Encourage others to do so, or

- In any manner that damages or is likely to damage our App, our website or the reputation of our Service.

 

You acknowledge that there are inherent limitations to video consultations and that in respect of certain medical situations, physical consultations may be a more appropriate way for a medical examination, diagnosis and/or consultation.  Such situations include, but are not limited to: situations requiring urgent or emergency care and serious, life threatening conditions. In such cases, always seek medical advice or call the emergency services.

Supported Services:

We provide the Application and the Website for patients and healthcare professionals to conduct telemedicine consultations. We facilitate telemedicine consultations with booking and billing systems and medical record storage. We do not provide medical services; these are provided by independent 3td parties in contract with DrJonasMed such as Healthcare Professionals using our Services. We reserve the right to terminate, cancel, or suspend any part of the DrJonasMed Services at any time without notice, and we shall not be liable for any loss or claim arising therefrom.

The telehealth services offer are a convenient and easy way to access medical services, but are not a substitute for a face-to-face consultation. In some cases, a telehealth consultation may end with a recommendation for a face-to-face visit. For urgent medical care, contact your local emergency services.

The Recording of our consultations provided through the DrJonasMedation Service is prohibited.

In the case of the video consultation service, you understand and agree that the medical evaluation/diagnosis provided shall be intended as a provisional opinion (or second opinion) and shall be solely based on the information made available, presented and discussed prior to or during the video consultation. Such medical evaluation/diagnosis is not intended to be a substitute for an in-person consultation or treatment. It is advisable to seek further clarification, examination, diagnosis and/or an in-person consultation for a more comprehensive medical assessment before beginning any definitive treatment apart from herbal treatment.

 You shall  comply with any instructions given in relation to any prescription provided to you including, in particular, route, timing and dosages;  promptly report any side effects of any prescription to a doctor;  check the labels of the medication prescribed to verify the medication matches the prescription before consuming the medication delivered;  protect anything prescribed to you and not permit any other person access to the prescribed medication; and  not use any prescription after its expiry date.

Health Services:

DrJonasMed doctors are responsible for all medical services provided through the DrJonasMed service, including evaluating the suitability of the service for your medical condition and maintaining appropriate medical records. Although we will do everything we can we cannot guarantee the quality of the medical services provided through the DrJonasMed Service.

 

Prices:

For the purposes of DrJonasMed billing, we act as the agent for other doctors and health care professionals. Unless otherwise noted, payment for the services is your responsibility. We charge a fee for each consultation provided through this service. We are not responsible for any additional charges you may incur (e.g. internet or mobile data charges).

Cancellations, exchanges and refunds

We may terminate, limit or suspend your use of the DrJonasMed service at any time If we terminate your use, we will retain and process your information in accordance with the applicable regulations. You may terminate your use by following our termination procedure, provided that you do not have any overdue charges. You will remain liable for any charges incurred prior to termination.

In respect to the Healthcare Services / Video Consultation function: Unless otherwise specified in the listing on the Platforms, you will not be entitled to a refund of such fees already paid  in the event that you cancel a scheduled appointment less than 24 hours in advance or if you miss a scheduled appointment or in respect of any consultation that has either been completed or terminated by you.

Products purchased through the website are also not eligible for exchange and are non-refundable. excluding the 100% Money Back Guarantee Services. Any requests made for refunds/exchanges in the event that the purchased product is damaged, or the service failed to fulfil its description  will be subject to DrJonasMed.com’s review on a case-by-case basis. The decision as to whether any refund/exchange should be allowed is at the sole discretion of DrJonasMed.com.

If for any reason, you are not entirely happy or not 100% satisfied with the services provided, we will provide a complete refund without any questions. Refund request should be received within 24 hours of your consultation.

The refund does not apply to the price of the medication that you pay. The administration reserves the right to deny future consultations/services if refunds are requested multiple times.

Termination

We have the right to terminate or suspend your account in our sole and absolute discretion without prior notice to you, for any reason at any time. Notwithstandingly any such termination or suspension, you remain liable for the outstanding amounts incurred by you.

Intellectual property

We own or license all intellectual properties in the application and the Website. This Agreement does not transfer our intellectual property rights to any other person. You are granted a limited right to use the DrJonasMedation Service in accordance with these terms and conditions and you may not infringe the intellectual property rights of the Application and the Website.

Confidentiality

Your data, including your medical records, will be stored in order to provide you with an immediate consultation service. Your data will be processed in accordance with applicable data protection regulations (GDPR = General Data Protection Regulations applicable in England) and our Privacy Policy. You consent us using your information for the purposes of providing medical services and developing the DrJonasMed service.

Liability and Indemnity

You are responsible for using the consultation service and for ensuring that others do not access it on your behalf. We will not be liable for any loss or claim arising from your use of the Service. You agree to indemnify us for any loss or claim relating to your use of the Service, unless such loss or claim is caused by our acts or omissions. DrJonasMed has a valid indemnity insurance in place provided by Holistic Insurance Services:

Claims/complaints

To resolve any dispute or complaint arising from your use of the Service, please notify us by emailing .  If the dispute is our responsibility, we will negotiate to resolve the dispute and if this is unsuccessful, we will refer the dispute to an independent third party agreed by both parties. The expert's decision is binding and the costs are shared equally. You cannot take legal action against us without following this procedure. Complaints about DrJonasMed doctors.

Governing law

These terms are subject to UK law. Any invalid, unenforceable or unlawful part of these terms and conditions shall be severed and the remaining terms and conditions shall continue to apply. You may not assign your rights under these terms without our written consent. These Terms constitute the entire agreement between you and us in relation to the DrJonasMed service.

 Disclaimer

This Agreement is solely between you and DrJonasmed and there is no contractual relationship between you and Westella Ltd. or its affiliates . DrJonasmed, and not Westella, provides the DrJonasmed service, application, website and related services. To the fullest extent permitted by law, you release Westella Ltd from any and all liability for any loss or claim arising out of your provision of the DrJonasMed Service, Application, Website or related services.
